Here's How to Get Your Seller's Permit and Other permits and Registrations You May Need. Seller's Permit, LLC, DBA, Licenses & Tax IDs Requirements:




First decide on a business structure Prepared Food as a Sole Proprietor, LLC/Corp, or Partnership.


Note that each structure requires a filing. E.g., selecting an LLC, requires at least an LLC certificate, an LLC operating agreement, a business license and a federal tax ID number.

All Prepared Food Businesses need a , Business tax registration also called an occupation business License

Selling/Leasing or if wanting to buy or sell Prepared Food merchandise, food, equipment requires a Seller's Permit.

All Prepared Food Businesses Using a DBA doing business as name need a DBA Fictitious Business Name

I am a Chef and will be preparing my own recipes of soups, salad dressings, and prepared salads to sell wholesale to local produce market and retail at a local farmers market. I will be renting a certified and state inspected kitchen by the use. I will be packaging in plastic containers and transporting in a cooled by ice cooler.

Even though you are a home business you still need all permits and tax ID numberss like any other businesss.       There is health related dangerous activity at business location and in such case a county health inspection may be required before a county business occupational permit is issued:   Sometimes the county will ask for an inspection if you manufacture or store anything hazardous.          
I am a home based business. Do I need licensing? Home business or Online businesses are not exempt from licensing requirement. You need all licenses a brick and mortar store needs. Physical location business. What if my business is not located in the city limits? My business may include health related hazard activity at business location:   There will be no hazardous merchandise in my home stored or made.          
Note that all home based business are subject to the same licensing requirement as any business. You are required to have all licenses as any business even if you are a home based business with small annual income.

You will need a sellers permit because prepared food is taxable.
Food businesses are peculiar in that in addition to other licenses and tax IDs, you may need a health inspection. The inspection may take place after you obtain your licenses here online on this site.
In addition, most states require that you take a food certification course ( about $20 depending on your state ). This is usually online and takes less than a day to be certified. This too, can be done after you set up your business. I.e., after you register your food business by obtaining the required licenses here online.
How to Register Your Food Business
First, select your food business structure: Select from Sole Proprietor, Partnership, LLC or Corporation.
Then, a sellers permit is required because you sell prepared food wholesale or retail.

Ido a couple of craft shows in North Carolina once a year, do I need a resale tax number?I can't seem to find my seller's permit number in my files on my computer ...is there a way to get a copy do I need a EIN if I have one in another state I am researching on what licenses are needed retail seafood sales. I would like sell handmade products ex. clothing, purses, shoes

Yes, you do because each time you sell anything you need to collect and pay sales taxes.  You also need a seller's permit to buy wholesale your craft supplies and items.

I obtained a seller's permit in the state of arizona, I'm selling clothing from a home-based business and I wanted to work with manufactures in California. Is the seller's permit transferable across state lines? What is the protocol for working with out of state manufactures and selling whole sale in-state.I have a seller's permit but misplaced the number. can you help?
