Here's How to Get Your Seller's Permit and Other permits and Registrations You May Need. Seller's Permit, LLC, DBA, Licenses & Tax IDs Requirements:




First decide on a business structure Flea Market as a Sole Proprietor, LLC/Corp, or Partnership.


Note that each structure requires a filing. E.g., selecting an LLC, requires at least an LLC certificate, an LLC operating agreement, a business license and a federal tax ID number.

Even though you are a home business you still need all permits and tax ID numberss like any other businesss.     Some businesses located outside the city limits may not need a city business permit but a county one but all other requirements such as a seller's permit if selling merchandise apply. There is health related dangerous activity at business location and in such case a county health inspection may be required before a county business occupational permit is issued: I will have vendors serving food. Sometimes the county will ask for an inspection if you manufacture or store anything hazardous.   Merchandise is stored at home business location so it it is an insignificant amount it is ok but a lot of merchandise may need a storage location for a home business permit to be issued: In a separated garage from home Home deliveries will occur regularly at home based business. Most cities will not allow too many deliveries so you need to either pick up your deliveries from UPS or limit the amount of trucks parking in front of you home: 2X per week
I am a home based business. Do I need licensing? Home business or Online businesses are not exempt from licensing requirement. You need all licenses a brick and mortar store needs. Note that all home based business are subject to the same licensing requirement as any business. You are required to have all licenses as any business even if you are a home based business with small annual income.

Selling at the Flea Market
Even though things look relaxed at the flea market, your duties are not. You will need to comply 100% with the legal licensing requirements.
So, first, select your Flea Market Business business structure: Like all businesses, you can choose from a Sole Proprietor, Partnership, LLC or Corporation.
Choosing the business legal structure is important because all tax IDs and other legal documents are filed under the type of legal structure.
It makes a big difference filing as a sole owner and filing as an LLC, for example.
Then, a seller's permit is required if you sell flea market merchandise wholesale or retail.
In fact, most of the items sold at a flea market, even food is taxable so you need a seller's permit.
Now let us say you hire a couple of guys to help you sell stuff at the flea market.
If so, you will be considered an employer and you will need a federal employer Number and a State Employer Number.
Users of a trade name will need a fictitious business name filing.
Finally, even if you are just a sole owner, and a small business, you have the option or incorporating or forming an LLC. If you do, you will not have to file a DBA.

Do I have to be a formal business in order to make handmade crafts and sell them online or from a store?

Yes, you need to become a business to sell handmade crafts. 

Thus, you first, select your business structure: Sole Proprietor, Partnership, LLC or Corporation. 

Then, a sellers permit is required to buy your craft materials wholesale and sell retail  if you sell handmade crafts merchandise wholesale or retail. 

If you are an employer, i.e., if you hire anyone to help you with handmade craft making, you will need a federal employer Number and a State Employer Number. 

Users of a trade name will need a fictitious business name filing.  For example, if you name your handmade craft business "Crafty but Arty," you will need to officially register that business name.

Finally, you have the option or incorporating or forming an LLC for your handmade craft business.
