Candy
QUESTION: Asked By: Celia 6/4/2020 12:00 AM

I sell candy and was told that I do not need a sellers permit for that item. However, I do need to buy wholesale for packaging, ingredients, etc. What do I need to buy wholesale if I don't need a seller's permit.

I am incorporated with only an EIN number. Good afternoon, I correctly have a photo booth business and wasn't to know if I will need licenses to add on a snowcone station, a cotton candy machine, a chocolate fountain, and a popcorn machine?

Well i leave in place where they said city dent come in here cause its like a dessert and other ppl sale food I only want to sale Mexican candy and chips and soda What are the requirements to sale candy and chips nd soda cans from home to the kids living int he same community.

ANSWER:
Hi Celia: Here is what you need for starting your
  business .

Selling Candy Candy

Registering Your Own Small New Candy Business

First, select your Candy business structure: Sole Proprietor, Partnership, LLC or Corporation.
The above step is important business all documents will be filed under the type of business organizational structure. After that, you will need to obtain a business permit.
This is a general Candy business permit that all new businesses must obtain.
Note that in the majority of the cases you do not need to obtain a Candy business permit that is specifically for your type of business.

You only need a general business permit.
In addition, all Candy businesses must be identified by a business tax ID called a federal tax ID number or Employer Identification Number (EIN). If you file as a sole proprietor, you can use your social security number instead of the federal ID.

Then, a seller's permit is required if you sell merchandise wholesale or retail.
The sellers permit is also called state ID, wholesale ID, resale ID, or re-seller license.
If you are an employer, you will need a federal employer Number and a State Employer Number.

If you do business as a name other than your full legal name, for example, you do business as "Candy Store 4 you," you will need to file a doing business as (DBA) filing.
Finally, you have the option or incorporating or forming an Candy LLC. Setting up as one of these corporate entities allows you not to file a DBA.

Home based business in Hammond. Mostly candy chips and soda selling to neighborhood children only. No online sells at this time. A: The Needed Permission To Sell candy chips and soda consists of the licensing you need such as a seller's permit. You can obtain all licensing for your candy chips and soda here including the business seller's permit because you will need it to buy wholesale and collect sales tax for in state Candy sales. You will also need a food handler's license that you can obtain online from a short online course. Also, keep in mind that "Angie's Candy LLC," is a trade name so you need to register it with a DBA, LLC or corporation. Since your name contains that suffix LLC, you will need to set up an LLC because you cannot use this suffix legally unless you are registered as an LLC.

Get Your Sweet Gig Legit, Richie!

Well, here's the 4-1-1 from comedy legends Woody, Mark, and George on what you need to keep your candy racket on the up and up:

  • LLC or Corporation - Protects your sugary empire from lawsuits by disgruntled customers with busted molars.
  • DBA - Register a snazzy biz name like "Richie's Rad Razzle-Dazzle Candy Shack" so customers know where to get their sugar fix.
  • Seller's Permit - Can't peddle peppermints in most states without tacking on sales tax - keep it sweet with the law!
  • Sales Tax ID - Uncle Sam wants a cut of your sweet sales so get ready to fork it over, buttercup.
  • Business License - Some fuddy-duddies require a license to sell locally - pay the man and stay out of the slammer!
  • EIN - Hire a junior taffy puller and get an Employer ID Number so the IRS doesn't roast you.

The rules vary big time state to state, so chat with an accountant to get the scoop on licenses needed to keep your candy racket legit...and you out of the pokey! Just remember the wise words of Willy Wonka: "Invention, my dear friends, is 93% perspiration, 6% electricity, 4% evaporation, and 2% butterscotch ripple." Keep hustling!

I am starting a party rental business bounce houses and concession machines such as snow cone and cotton candy

"Cathy's Candies," is a business name so you need to register this with a DBA, LLC or corporation. Then you can use that name in your advertising and stationary. To buy the candies wholesale (tax free), you need a wholesale license also called a sales tax ID or seller's permit. Of course, all businesses need a business license as well.

Rich, whether you need an LLC, DBA, or tax ID for a candy business depends on a few factors, including how you plan to structure your business, where you live, and what kind of candy you sell.

If you're just starting out and you're not sure how big your business will get, you may want to start as a sole proprietorship. This is the simplest business structure, and it doesn't require you to file any paperwork with the state. However, as a sole proprietor, you're personally liable for all of your business debts and liabilities.

If you're concerned about personal liability, you may want to consider forming an LLC. An LLC is a limited liability company, which means that your personal assets are protected from business debts and liabilities. To form an LLC, you'll need to file paperwork with the state and pay a filing fee.

If you're planning to sell your candy online or to other businesses, you'll need to get a reseller's permit from your state. This permit allows you to collect and remit sales tax on your sales.

If you plan to hire employees, you'll need to get an employer identification number (EIN) from the federal government. An EIN is like a Social Security number for businesses. You'll use your EIN to open a business bank account and to file your business taxes.

Here's a quick summary of the different business structures and tax IDs you may need for a candy business:

Sole proprietorship: No need to file any paperwork with the state, but you're personally liable for all business debts and liabilities.
LLC: Limited liability company that protects your personal assets from business debts and liabilities. Requires filing paperwork with the state and paying a filing fee.
Reseller's permit: Required if you plan to sell your candy online or to other businesses. Allows you to collect and remit sales tax on your sales.
Employer identification number (EIN): Required if you plan to hire employees. Like a Social Security number for businesses.
Mark Twain:

Rich, if you're planning to start a candy business, you'll need to get your affairs in order before you start selling your sweets. This includes getting the proper business structure and tax IDs.

I'm not a lawyer or accountant, so I can't give you specific advice. But I can tell you that it's important to do your research and understand the different business structures and tax IDs that are available to you.

If you're not sure where to start, I recommend talking to a lawyer or accountant who specializes in small businesses. They can help you choose the right business structure and tax IDs for your needs.

George Carlin:

Rich, I'm not going to lie to you. Starting a candy business is a lot of work. You have to come up with a great product, market it effectively, and deal with all the government regulations.

But if you're passionate about candy and you're willing to put in the hard work, it can be a rewarding experience. And who knows, you might even become the next Willy Wonka!

Here's a motivational quote to get you started:

"If you want to fly, give up everything that weighs you down." - Buddha

Now get out there and start selling some candy!

Conclusion

Whether or not you need an LLC, DBA, or tax ID for your candy business depends on a few factors, including how you plan to structure your business, where you live, and what kind of candy you sell. It's important to do your research and understand the different business structures and tax IDs that are available to you. If you're not sure where to start, I recommend talking to a lawyer or accountant who specializes in small businesses.

A: You Should Get A Business License and a Sellers Permit because you will need at least 2 license permits: A business license, and a seller's permit. In addition, since "Tete Sweet Treats," is a trade business name, you will need to register it with a DBA, LLC or corporation.
In Michigan City , the requirements for Selling Candy are the same as anywhere in the U.S.
