Hi Willie, wood work is like manufacturing because you need to buy the materials wholesale and then work on them and then sell them retail. You need a resale license for that in addition to a DBA, LLC or corporation, an EIN and a business license. For example, assume that you buy a piece of wood, and you create a wooden toy from it. Even though you might be able to buy the wood item tax-free, selling the wood toy is not tax-free. Even if you sell it wholesale, you still need a wholesale license.

Whether a Wood Working online, home, store, concession stand or a mobile cart, you will need to first select among sole owner/proprietor, partnership, LLC or corporation, all of which also require a General Business License (not a specific license for your type of business) as well.

Also, note that whatever item that you sell or lease, and it is an item that can be touched (i.e., tangible items such as equipment, toys, merchandise, electronics, prepared food) requires a state sales tax ID (Seller's permit) to either buy or sell the items or products wholesale and/or sell them retail. If you are hiring workers anytime soon, you will need a Federal EIN and a State EIN (Wood Working employer identification number).

Other instances where you will need a federal tax ID are: if you are a partnership, an independent contractor, and a corporation or an LLC. You can also obtain a federal tax ID as the sole proprietor and use it as a business tax ID in the place of a social security number.

However, you will still need other WoodWork registrations, such as licenses, an assumed business name, DBA, and tax IDs as described above. Finally, even one person, sole owner/proprietors working from home or just online can form an LLC or incorporate, in which case, they will not need to file a DBA.

We're looking at opening a sewing/mending shop with some homemade goods (wood working, jewelry etc.) would this fit under an LLC?

The tea service I provide is simply making and serving tea. It's done at music events and I also have a mobile tea lounge.

Answer: You need at least a seller's permit because you need to buy the wood wholesale and sell the items retail or wholesale and that requires a seller's permit. Furthermore, selling tea at concerts is a taxable event. You need to charge sales tax when you sell tea at shows. You can server tea under the same licensing as your wood work business.


Question: If I file as an LLC, I still need an EIN, yes?

Answer: You don't need an EIN, but if you treat the LLC as a corporation, you do. If you treat the LLC as a disregarded entity, you don't have to get an EIN, but you can get a use one as the LLC business ID otherwise, you will need your SSN to identify the LLC.

What do I do to obtain a seller's permit for a flea market in Columbia, Tn? I am not wonderful with computers on knowing what to do. Can I apply somewhere in Columbia to obtain my seller's permit? What is the cost, and what if we don't sell the whole season? When we lived in Fl.

We went to a place to get a tax license, and it only runs us. "I hate to pay a lot and then not sell the whole season. Would appreciate information you can send me via email.

Also, our printer does not work, so what do I do then?? Thank you for your time.

You need the seller's permit because you need to collect sales tax for the sale of clothing and other materials.
