To set up and register your business it does not matter whether your business is an online, home, store, concession stand or a mobile cart, you will have to first select a business type entity from these tax structures:

The sellers permit is also called a sales tax ID, a state ID (there are 2 state IDs and the other one is called an state employer ID but you most likely need the sales tax ID from the state ).

Getting people to work for your business anytime within 30 days of starting your business subjects you having to get a Federal EIN and a State EIN (employer identification number).

On the other hand, you will also need a federal tax ID if you are a partnership, an independent contractor, and a corporation or an LLC .

It is always a good idea obtain a federal tax ID as a sole proprietor and use it as a business tax ID in the place of a social security number.

However, you will still need other filings business tax registrations, such as permits, a fictitious business name DBA, and tax IDs as described above. For example, if you want to be an LLC, you must obtain an LLC certificate and an LLC operating agreement as well as an EIN.

You need the EIN to be the LLC ID in addition to being an Employer ID if you hire workers.

Finally, even sole proprietor working from home or just online can set up a LLC or incorporate, in which case, they will not need to register the trade name with a DBA because the LLC or Corporation name will be the legal name of the business.

A DBA stands for Doing Business As and it is also called a fictitious, assumed, trade firm or business certificate trade name.

what else do I need to sell merchandise on the street? I have a small business screen printing t shirts, in order for me to get tshirts wholesale they say I have to hgave a retail certificate i want to know how can i get a permit to sell t shirts I need a resale permit. I think Iwill form a corp or LLC soon ...

but would prefer not to be tied to a state right now. does a resale permit have to be tied to a state? We will also have designs printed in T-shirts, hats etc. (probably in the US - but hats made in China) We will manufacture gifts - mostly in China - ceramics, etc.

if i just wanted to sell t shirts in the state of fl do i need a license so if i just wanted to sell t shirts from home or from my car i would still need to do all of the above.

Who must file

Rate of tax

As of October 1, 1996, the four percent state Sales Tax (get Seller's Permit) rate consists of 3.97 percent Louisiana state Sales Tax (get Seller's Permit) , and .03 percent Louisiana Tourism Promotion District Sales Tax (get Seller's Permit) . Telecommunications and sales of prepaid telephone cards and prepaid telephone authorization numbers are subject to a three percent tax rate. From July 1, 1986 through June 30, 2002, certain traditionally exempt transactions were subject to state Sales Tax (get Seller's Permit) ranging from one to four percent.

Frequency and Date payment and return due

Sales Tax (get Seller's Permit) returns and tax payments are due on or before the 20th of the month following the close of the calendar month or calendar quarter of the reporting period.

Basis of tax

The state general sales and use tax is levied on the following transactions:

  1. The sale of tangible personal property at retail in Louisiana

  2. The use, consumption, distribution, or storage for use or consumption in Louisiana of any tangible personal property;

  3. The lease or rental within Louisiana of any item or article of tangible personal property; and,

  4. The sale of services as defined in the statutes under R.S. 47:301(14), which include the following:

    1. the furnishing of rooms by hotels;

    2. the sale of admissions to places of amusement and to athletic and recreational events,

    3. the furnishing of privileges of access to amusement, entertainment, athletic, or recreational facilities;

    4. the furnishing of storage or parking privileges by auto hotels and parking lots;

    5. the furnishing of printing and overprinting;

    6. the furnishing of laundry, cleaning, pressing, and dyeing services;

    7. the furnishing of cold-storage space and the preparation of property for such storage;

    8. the furnishing of repairs to tangible personal property; and

    9. the furnishing of telecommunications services.

  5. Telecommunications and sales of prepaid telephone cards and prepaid telephone authorization numbers are subject to a three percent tax rate.
